Judicial exemption for civilians who prevent "terrorist incidents"!

While discussions on the Decree No. 696 are ongoing, the Turkish Government officials argue that this is bringing jurisdiction exemption to civilians who prevent "terrorist incidents".

Some of the articles in Decree Laws 695 and 696 issued last Saturday night were caused discussions between political parties in Turkiye.

Within the scope of the Decree-Law no. 6755 dated 8 November 2016, a new clause has been added to Article 37 of the Law Amending the Decree on the Implementation of the Measures to be taken under the Extraordinary Status and the Regulation on the Implementation Regulations for Some Institutions and Organizations.

Accordingly, jurisdiction exceptions to those who prevent "terrorist actions" and its continuing actions on the coup attempt carried out on July 15, 2016, irrespective of whether they carry an official title or not, whether they fulfill an official duty or not.

With the last delegated legislations, some of the items led to debate among political parties. Those who argue that the impunity regulation regarding the illegality of any person cannot be held liable despite a criminal act, demanded the cancellation of the Decree Law No. 696.

The AK Party Central Executive Board member and Istanbul deputy Burhan Kuzu, who twitted via his account on the matter, stated that they brought jurisdiction exemption to civilians preventing "terrorist incidents" with delegated legislation numbered 696.

"The summary is: If a July 15-like coup or terrorist attack occurs, our citizens who will intervene and prevent this betrayal will be legally protected by law."

The AK Party Spokesman Mahir Ünal said yesterday that this article, which was interpreted as "impunity", covered only the events of 15 and 16 July 2016.

"We are talking about what happened that night." Ünal said and added: "It is quite normal to add those who went to the streets to protect the country that night, besides the decision to protect the soldiers, members of the security forces and the civilian personnel that night."
